Most UAE tax penalties don't come from evasion or bad intent. They come from a missed deadline, a form nobody knew about, or a business owner assuming a rule didn't apply to them. The FTA's penalty system doesn't distinguish — it's administrative and largely automatic.
What fewer people know is that the system also has a formal appeal route, and that well-prepared reconsideration requests genuinely succeed. Both halves are worth understanding.
The penalty price list
| Mistake | What it costs |
|---|---|
| Late Corporate Tax registration | AED 10,000 fixed |
| Late VAT registration | AED 10,000 fixed |
| Late VAT return filing | AED 1,000 first time; AED 2,000 per repeat within 24 months |
| Late Corporate Tax return filing | AED 500/month for the first 12 months; AED 1,000/month from month 13 |
| Late VAT payment | 2% of unpaid tax immediately, with further monthly percentages accruing on the balance |
| Errors in filed returns | Separate fixed penalties, plus the underpaid tax itself |
Two patterns worth noticing. First, registration penalties don't care whether you owe tax — a company with zero revenue pays the same AED 10,000 for registering late. Second, the Corporate Tax filing penalty compounds monthly. A return that's a year late has already cost AED 6,000, and the meter keeps running.
Penalty reconsideration: the part of the system that works in your favour
If you've received a penalty, you have the right to submit a reconsideration request to the FTA asking for it to be reviewed, reduced, or waived. This is a formal legal process, not a complaint form — and that's exactly why preparation quality decides outcomes.
A few things determine whether a reconsideration succeeds:
- Timing. Reconsideration requests must be submitted within the FTA's set window from when you receive the penalty. Sitting on a penalty notice for months usually closes the door.
- Grounds. "We didn't know" rarely works alone. Genuine grounds — system errors, documented circumstances beyond your control, first-time compliance failures with an otherwise clean record, prompt voluntary correction — carry real weight.
- Documentation. The request needs evidence, a clear timeline of events, and legal framing in the format the FTA expects. Well-drafted requests with supporting documents are treated very differently from two-line appeals.
Worth knowing: the FTA has waived or reduced substantial numbers of penalties through this process, particularly where businesses corrected their position quickly and could show the failure wasn't habitual. A penalty notice is a bill, but it isn't always a final one.
The order of operations if you've just received a penalty
- Fix the underlying breach first. If the penalty is for a missing registration or return, complete it immediately — ongoing non-compliance undermines any appeal and, for monthly penalties, keeps the meter running.
- Check your reconsideration deadline. Count from the date you received the penalty decision, and don't spend that window deliberating.
- Gather your evidence. Correspondence, system records, medical or travel documents if relevant, proof of your compliance history.
- Prepare the request properly or get help doing it. This is one place where professional drafting demonstrably changes results.
Cheaper than the penalty, always
